Vice President & Associate General Counsel, Regulatory

The Associate General Counsel, Healthcare Regulatory and Transactions (AGC-HRT) serves as principal counsel supporting all levels and teams within Akumin on healthcare regulatory compliance and transactions matters. The AGC-HRT works closely with the compliance, operations, and strategy teams to identify potential areas of risk and exposure related to healthcare regulatory issues and transactions to coordinate the effective mitigation or elimination of such risks. The AGC-HRT oversees the delivery of legal services and resources, including coordinating with external lawyers and advisors, to accomplish company goals, strategies, and priorities.

Specific duties include, but are not limited to:

Counseling the enterprise and providing clear, practical guidance on compliance with federal and state healthcare laws and applicable regulations, including but not limited to:

  • The False Claims Act

  • The Anti-Kickback Statute

  • The Stark Law

  • The Civil Monetary Penalties Law

  • HIPAA, HITECH, and other laws governing privacy and security of health information

  • Corporate Practice of Medicine

  • Medicare and Medicaid reimbursement rules

Advising the company on a variety of healthcare regulatory issues related to complex transactions, including:

  • Maintaining a deep understanding of the company's business objectives

  • Providing leadership and guidance on strategic decisions from a legal perspective, with an emphasis on identifying creative solutions to complex problems

  • Conducting due diligence and risk assessments

  • Drafting, reviewing and negotiating legal documents and contracts

Serving as legal advisor on joint venture relationships

Providing legal oversight for the companys Licensure and Credentialing program.

Interfacing with Federal and State regulatory and enforcement agencies in connection with self-dis

closures, audits, or investigations.

Directing and overseeing privileged internal audits and investigations on healthcare regulatory topics.

Leading reviews of proposed and enacted healthcare regulatory statutes and regulations that may impact Akumins business, and educating internal stakeholders accordingly.

As appropriate and as assigned, managing junior in-house counsel and/or support staff.

Other duties as assigned.

Position Requirements:

  • Doctoral Degree (JD, PhD)

  • Licensed to practice law in at least one state

  • JD from an accredited law school

  • Minimum 10 years of law practice

  • 5% travel may be required.

Preferred

  • Strong leadership and management skills

  • Deep knowledge of healthcare fraud and abuse laws

  • Excellent communication and interpersonal skills, with the ability to interact effectively with all levels of the organization and external parties

Physical Requirements:

Standard office environment.

  • Sit, stand, walk.

  • Repetitive movement of hands, arms and legs.

  • See, speak and hear to be able to communicate with patients.

Less than 50% of the time:

  • Stoop, kneel or crawl.

  • Climb and balance.
