Senior Counsel - Litigation
Overview
The Senior Counsel Litigation will be responsible for providing strategic legal guidance for all legal aspects of the companys litigation and assisting the General Counsel or Assistant General Counsel with managing internal and external legal resources.
Essential Functions
- Manage consumer and commercial litigation, in federal and state courts and in arbitration, across the U.S.
- Oversee outside counsel to provide local assistance with litigation matters
- Resolve consumer and commercial disputes, including negotiating settlements
- Research to support litigation issues, both federal and state laws, including:
- Fair Debt Collection Practices Act (and state analogs)
- Fair Credit Reporting Act (and state analogs)
- Telephone Consumer Protection Act (and state analogs)
- Truth In Lending Act
- Equal Credit Opportunity Act
- Laws restricting unfair, deceptive, or abusive acts or practices
- Repossession laws
- Usury laws
- Oversee legal department processes for litigation
- Draft and edit litigation filings
- Provide legal advice, guidance, and support to internal business units on litigation
- Counsel internal business units on litigation, including underwriting, servicing, risk, audit, fraud, loss mitigation, and executives
- Advise on compliance with consumer protection laws and regulations in litigation matters
- Identify and recommend steps to contain cost and mitigate risk
- Other tasks as assigned
Qualifications
- Juris Doctor or LLB degree
- Active bar admission in at least one U.S. jurisdiction
- 5 10 years of consumer finance litigation experience; auto finance experience preferred
- Excellent negotiation, communication, and drafting skills
- High level of professionalism
Supervisory Responsibility
This position may supervise Analysts (and/or Staff Attorneys)
Work Environment and Physical Demands
This job operates in a professional office environment. This role routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines. Reasonable accommodations may be made to enable individuals with disabilities to perform the essential functions.
Position Type/Expected Hours of Work
This is a full-time in the office position with a work schedule of Monday-Friday, with some schedule variations as needed. The position is resident in Spartanburg, SC
Travel
This position may require up to 10% travel.
