The primary purpose of this position is to provide legal services in the Information Technology (IT) field to the Department of Health and Human Services, specifically the Division of Information Resources Management (DIRM). The position provides other legal services to DHHS as the need arises. It also provides such other legal services as may be assigned by the Office of the Attorney General, such as representing the State in non-capital criminal appeals.

Provide Legal Services to the DIRM
  • This position will provide legal services in contract and procurement activities in the Information Technology (IT) field for the Division of Information Resource Management (DIRM) of the Department of Health and Human Services (DHHS).
  • Services will include participating in the preparation of Requests for Proposal and resulting contracts, procurement processes, contract negotiations, and contract oversight and compliance in connection with IT goods and services.
  • Negotiation The attorney must have the ability to conduct contract negotiations with sophisticated technology vendors.
  • Contracts Drafting, review, and administration of complex contracts for information technology project management and procurement.
  • Specialized Expertise Federal copyright law; software licensure, including escrow and maintenance agreements.
  • Litigation Proceedings Required litigation skills include independently conducting depositions, drafting motions and bench briefs and conducting courtroom or hearing room advocacy in complex information technology cases before state courts and administrative bodies.
  • Coordination This attorney coordinates the efforts of the client agency to present a defensible legal position at all times and must be adept at client counseling.
Provide Legal Services to Other DHHS Components
  • This attorney will also provide legal services to other DHHS agencies, primarily in contract negotiations and review. The attorney will serve as a particular resource on IT matters and intellectual property questions arising in the various DHHS agencies.
Represents the State in Criminal Appeals
  • This position represents the State in criminal appeals to the North Carolina Court of Appeals and North Carolina Supreme Court. Duties include analysis of legal issues, legal research, preparation, as appropriate, of pleadings, memoranda of law, appellate briefs and oral argument in the appellate courts.
This position requires travel, including overnight travel, as part of its assigned duties.

Work Schedule:
The regular work schedule is from 8:00 AM to 5:00 PM, Monday through Friday. The caseload and other responsibilities may occasionally require that additional hours be worked. Hybrid telework opportunities are available for this position.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.


THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $84,878 to $100,179. Client funded. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

· Ability to establish and maintain effective working relationships;
· Ability to conduct complex litigation in the Office of Administrative Hearings, trial and appellate courts;
· Ability to perfect, brief and argue complex administrative, civil and criminal appeals in the appellate courts;
· A thorough knowledge of case, statutory, regulatory, and common law of North Carolina;
· A thorough knowledge of the North Carolina Administrative Procedures Act, the North Carolina Rules of Civil Procedure, and the North Carolina Rules of Appellate Procedure;
· Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions;
· Ability to analyze, interpret, and apply facts, rules, statutes, appellate decisions, and legal instruments;
· Ability to express conclusions and arguments clearly and logically in oral and written form;
· Ability to determine issues in various cases;
· Ability to analyze complex legal problems and render opinions; and

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
