This position is located in the General Law Unit of the DOTD Legal Section. Under the oversight of an Attorney Supervisor, Attorney 4, and other senior attorneys, this position is responsible for providing guidance to department staff on pre-litigation claim processing and representing the department in negotiation, mediation, or litigation in connection with claims for damages suffered by the department, disputes relating to the General Law Unit's areas of expertise, or otherwise, as assigned.

The maximum salary for the Attorney 3 is $109,325. This position has the following Special Entrance Rates:
Attorney 1 - $2,166.40 bi-weekly
Attorney 2 - $2,318.40 bi-weekly
Attorney 3 - $2,561.60 bi-weekly


The incumbent of this position shall receive premium pay up to $2.00 an hour, for hours actually worked.

MINIMUM QUALIFICATIONS:
Possession of a license to practice law in the state of Louisiana.
Function of Work:
To assist an attorney of higher rank in the preparation of court cases and/or advisory opinions and may litigate and/or prepare advisory opinions in cases of a routine nature.

Level of Work:

General from a higher ranking attorney, administrative law judge, or other agency administrator/executive.

Job Distinctions:
Differs from Attorney 2 by the level of supervision received and the level of expertise required in the preparation of legal opinions/courts cases assigned or hearings conducted.This position requires a license to practice law in Louisiana. The position is one of four staff attorney positions in the General Law Unit of the DOTD Legal Section. Under the oversight of an Attorney Supervisor, Attorney 4, and other senior attorneys, this position is responsible for providing guidance to department staff on pre-litigation claim processing and representing the department in negotiation, mediation, or litigation in connection with claims for damages suffered by the department, disputes relating to the General Law Unit's areas of expertise, or otherwise, as assigned. The incumbent also performs other tasks as assigned.

While in official capacity, DOTD employees must comply with all applicable Louisiana and Civil Service laws, rules, and regulations, as well as DOTD policies, procedures, manuals, and directives.

Third Party Liability (Claims): Conducts collection activities prior lo litigation in conjunction with Third Party Liability Unit when a third party is believed to be liable for damages sustained to DOTD property as a result of an accident (approximately 1,000 claims for reimbursement annually). This work requires knowledge of tort law, as well as state and federal collection and bankruptcy practice. Responsibilities include all activities necessary to effect maximum collections, including negotiating settlements, gathering evidence, and interviewing witnesses, as applicable. Claims frequently involved the application of law to complex factual situations, and must be processed in a high-volume environment in which time is frequently limited. The incumbent must communicate with representatives of insurance companies of impacted insureds to obtain additional information and/or discuss the amount oftl1e claim determinations made for specific damaged property. The incumbent communicates the results oftl1e damages evaluations to DOTD Assistant Secretary of the Office of Operations ru1d the District Administrators and personnel and maintains records of the damage claim determinations performed, including all relevant supporting documentation. The incumbent proV1des additional support to DOTD Assistant Secretary of the Office of Operations by coordinating the negotiation and execution of Settlement Agreements with insurance companies and insureds owing money for the repair of the damaged DOTD property.

Negotiation, Mediation, and Litigation: As assigned by the General Counsel, Deputy General Counsels, or Attorney Supervisor over the General Law Unit, handles full file responsibilities or supports other attorneys in ru1y negotiation, mediation, or litigation matter involving the Department. This responsibility includes, but is not limited to, assisting a specialist attorney with the collection of monies owed to the Department for damage done to its property by third parties. Responsibilities include gathering evidence, drafting and filing pleadings, arguing motions and exceptions, interviewing and preparing witnesses, negotiating settlements, and prepa1ing and participating in trials. Cases frequently involved the application of law to complex factual situations, and must be processed in a high-volume environment in which time is frequently limited.

Agreements and Other Specialized Contracts: Researches, develops, drafts, and reviews agreements and otl1er specialized contracts between tl1e Department and private and public parties, as assigned by the General Counsel, Deputy General Counsels, or Attorney Supervisor over the General Law Unit. As part of this responsibility, ensures that all provisions of assigned agreement or contracts comply with all applicable laws, and protect the interests of the Department to the extent practicable.

Advice and Counsel: Provides advice and counsel on any matter assigned by the General Counsel, Deputy General Counsels, or Attorney Supervisor over tl1e General Law Unit.

Other Duties: May be required to perform other duties as directed including, but not limited to, emergency and disaster support activities.
