Senior Patent Litigation Counsel Specialist, Assistant General Counsel

The Position

The Genentech Litigation team is seeking a Senior Patent Litigation Specialist, Assistant General Counsel whose expertise lies in litigating and advising to enable Genentech to do now what patients need next. As a partner and key business strategist, this individual will have deep experience in managing complex patent litigations and other adversarial proceedings in the pharmaceutical, biotechnology, or related life science industry. This position will be based onsite in South San Francisco, CA and does not include fully-remote as an option; relocation benefits are available for this job posting.

Key Functions:

  • Independently manages an active and varied caseload of litigations, appeals, and other adversarial proceedings, while advising on substantive legal strategy with foresight and appropriate risk tolerance.This includes setting case strategy and closely driving the usage, management, and deliverables of pertinent outside counsel. Matters expected to include a range of patent litigation proceedings, including ANDA and biosimilar matters, as well as certain non-patent litigation.

  • Serves as a thought leader for the litigation practice group and patent group on issues including ANDA patent litigation strategy.

  • Partners closely with senior business clients and legal department colleagues to advise on a range of strategic issues while using a practical and business-minded approach.

  • Develops strategies to avoid or resolve regional, national and international disputes, including directly negotiating license agreements and settlements.

  • Counsels on multi-jurisdictional litigations or other proceedings, including coordinating with counterparts in the US and around the world.

  • Contributes to cross-functional or departmental projects and teams.

  • Works effectively in teams and with a cross-section of stakeholders within the organization.

  • The successful candidate must also be able to work closely and independently with internal domestic/international commercial, research & development, manufacturing, partnering, finance and tax units, among other business units.

  • This position requires being in the office three days per week (of which Mondays and Wednesdays are required onsite days) when not away as needed for business matters. However, 8 weeks of episodic remote work is available per year.

Experience/Education:

  • J.D. with at least 10+ years of litigation experience, with extensive experience in directly managing complex adversarial matters in the pharmaceutical, biotechnology or related life science industry.

  • Deep experience with Hatch-Waxman ANDA and/or biosimilars matters strongly preferred.

  • Experience with investigations, commercial contract disputes and/or product liability cases, and/or experience in an in-house setting is also preferred, but not required.

  • Must be currently admitted and in good standing to a State Bar or the District of Columbia Bar.

  • Trial experience and experience with PTAB proceedings strongly preferred.

  • Excellent academic credentials required.

  • A degree (undergraduate or graduate) in a biological science or chemistry preferred but not required.

The expected salary range for this position based on the primary location of California is$205,730 to $382,070. Actual pay will be determined based on experience, qualifications, geographic location, and other job-related factors permitted by law.
