About Us:

The State Medical Board of Ohio issues licenses and oversees the practice of allopathic physicians (MD), osteopathic physicians (DO), podiatric physicians (DPM), massage therapists (LMT), and various other allied health care professionals under the authority of the Medical Practices Act, Chapter 4731, Ohio Revised Code (ORC). The Medical Board continues to regulate naprapaths and mechanotherapists licensed by the Board before March 1992.

The Medical Board also regulates Physician Assistants, ORC Chapter 4730, Dietitians, ORC Chapter 4759, Anesthesiologist Assistants, ORC Chapter 4760, Respiratory Care Professionals, ORC Chapter 4761, Acupuncture, ORC Chapter 4762, ORC, Radiologist Assistants, ORC Chapter 4774, and Genetic Counselors, ORC Chapter 4778.

The Medical Board’s regulatory responsibilities include investigating complaints against applicants and licensees and taking disciplinary action against those who violate the public health and safety standards set by the General Assembly and the Medical Board.

What You'll Do:

The State Medical Board of Ohio is seeking an experienced Attorney to join our Legal team with a focus on the Board's Licensure processes. This person will work under the general direction of our Senior Legal Counsel and will require considerable knowledge of substantive and procedural law in order to provide legal advice on policy development related to licensure.

Under the direction of the Senior Legal Counsel this position will:

  • Provide legal advice and guidance on matters involving the Board’s licensure processes, including pending legislation, administrative rules, implementation of laws and rules, and development of reports and processes to comply with applicable laws and rules.

  • Assist with resolving complex legal issues related to licensure with the Medical Board.

  • Update licensure status based upon formal action by the Board.

  • Develop and negotiate settlement agreements involving non-disciplinary matters under the direction of the Board’s Secretary and Supervising Member.

  • Develop non-disciplinary notices for opportunity for hearing based upon the Board’s recommendation.

  • Conduct legal research of case and statutory law, constitutions, state and federal regulations and legal treatises and drafts relevant rules and legislation.

  • Draft correspondence, articles, reports, statutory language, policy statements, processes, and other related materials on behalf of the Board.

  • Draft disciplinary and non-disciplinary final orders, journal entries and packets of evidence for cases proceeding to the Hearing Unit or Board.

  • Prepare and present memoranda, proposed rules, legislation, policies, processes, and other documentation for the Board’s review.

  • Prepare administrative rules for the Board’s adoption.

  • Participate in administrative triage of complaints and advises Medical Board Secretary and Supervising Member regarding appropriateness of investigations and disposition of complaints.

  • Respond to legal inquiries from the public and government officials, including public records requests, requests for confidential investigative information under R.C. 4731.22(F)(5), and subpoenas.

  • Assist lower-level attorneys on complex questions of law and cooperates with the Office of Attorney General on legal issues as required.

  • Commit to satisfying internal and external customers by responding to requests in a timely manner, proactively identifying customer needs and working to resolve customer complaints.

Pay Rates:

Unless required by legislation or union contract, candidates can expect to be paid at the lowest rate in the salary range (Step 1).
