Job Description:

SVP, Deputy General Counsel

Reporting to the EVP, Chief Legal Officer and General Counsel, the SVP, Deputy General Counsel will be a key member of the Legal Department leadership team, Discovers Management Committee and will oversee the following advisory support areas:

  • Direct Banking Deposits and Collections and Consumer Banking Products
  • Credit - Acquisition, Payments, Discover Home Loans, Discover Personal Loans and Discover Student Loans
  • AML/BSA
  • Fair Lending and Credit
  • Prudential Regulation

Responsibilities:

  • Provide strong thought leadership and legal advice to senior management, business lines and other stakeholders on the full range of legal and regulatory issues impacting applicable to Discovers consumer products and services, including federal and state consumer financial services laws and regulations and supervisory matters.
  • Provide guidance on federal and state examinations, investigations and litigation involving consumer products offered by Discover.
  • Advise business lines on all consumer products and offerings.
  • Furnish guidance regarding federal laws such as the Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Credit Card Accountability Responsibility and Disclosure Act of 2009 (CARD Act), Unfair, Deceptive, or Abusive Acts and Practices (UDAAP), Fair Credit Reporting Act (FCRA), Truth in Savings Act (TISA), Electronic Fund Transfer Act (EFTA), Service Members Civil Relief Act (SCRA) and Home Mortgage Disclosure Act (HMDA).
  • Support achieving business strategies and results through legal advice that reflects an advanced ability to understand and evaluate legal and regulatory matters in the context of risk appetite and business objectives.
  • Support and advise business leaders and other stakeholders on supervisory and examination matters.
  • Assess and communicate changes in laws and regulations and work with colleagues and business partners to implement changes.
  • Collaborate with Corporate Compliance to develop positions and strategies on regulatory policy matters and coordinate with Government Affairs Group on advocacy activities
  • Work closely with Corporate Risk, Corporate Compliance and Internal Audit on consumer compliance and regulatory matters.
  • Oversee, manage, coach and develop a high performing team of 30+ attorneys and professionals.
  • Serve as a role model to others on the regarding Discover Behaviors such as We Succeed Together and We Get Better Every Day.

Requirements:

  • Juris doctor
  • Admission to a state bar
  • 20+ years of experience in consumer financial services law
  • Senior legal or advisory position held at two or more of the following regulatory agencies: FDIC, Consumer Financial Protection Bureau, Federal Reserve, or the Office of Comptroller of the Currency.
  • Law firm experience advising clients on federal and state consumer financial services laws and representing clients before federal banking agencies in examination and enforcement actions. required
  • Senior-level in-house position at a large consumer bank (e.g. law firm, in house, and/or regulatory agency)
  • Experience leading a large team of attorneys and legal professionals (minimum of 15 attorneys)
  • In-depth understanding of how legal issues affect organizations
  • Ability to set strategic direction and deliver practical, risk aware business solutions
  • Demonstrated ability to work in a highly collaborative, interdependent environment in which success depends on shared opportunities, responsibility, and accountability
  • Excellent communication skills and executive presence, with the ability to make complex legal matters understandable to non-attorney business leaders/stakeholders
