The Senior Counsel (Consumer/Retail Banking) is a position within Simmons Banks legal department responsible for providing legal advice to the bank on laws and regulations affecting consumer and retail banking, including the banks deposit, digital banking, credit card, mortgage, and lending operations and activities. This individual will work with management throughout the bank to advise on strategic initiatives and effectively address legal and regulatory matters associated with the banks products and services. This individual will report directly to the banks Assistant General Counsel.

Essential Duties and Responsibilities

  • Provide legal support for strategic initiatives and new product and service offerings across the bank, with a focus on consumer banking, digital banking, and credit card business lines

  • Provide expert advice to senior management concerning laws, rules, and regulations affecting the banks products and services, including regulations issued by the Federal Reserve, FDIC, CFPB, and other federal and state regulatory agencies

  • Draft product agreements, terms and conditions, and disclosures as well as correspondence, memoranda, contracts, and other legal documents

  • Monitor, research, and analyze existing laws, rules, and regulations (and changes thereto) to evaluate and assess their impact on the bank

  • Direct and supervise outside law firms on specific projects, when appropriate

  • Work with representatives from various business units to develop, modify, and interpret policies, practices and procedures to conform to legal requirements and to ensure legal compliance

  • Perform other duties and responsibilities as assigned

Qualifications

  • Ability to draft product agreements, terms and conditions, and disclosures

  • Ability to read, analyze, and interpret financial reports and/or legal documents

  • Ability to effectively present information to senior management

  • High level of expertise in banking or other relevant area of law that results in independent work with little direction or oversight required

  • Strong critical thinking skills.

  • Detail oriented with excellent legal judgment

  • Ability to synthesize and advise on complex fact and legal topics

  • Strong writing, project management, and organizational skills

  • Ability to communicate effectively across multiple channels

  • High degree of adherence to ethical standards

Education and/or Experience

  • A law degree from an accredited law school

  • Admission to at least one state bar

  • Preferably three to seven years of experience as an attorney in a large law firm, regulatory agency, or corporate legal department

  • Experience advising on some or all of the following banking laws and regulations: TILA, RESPA, ECOA, FCRA, Reg. E, Reg. DD, UDAAP, GLBA, TCPA, E-Sign, UCC

  • Ability to maintain the highest level of confidentially and sensitivity towards all work-related information

Location

This position may be located anywhere within the banks footprint, including the following cities: Little Rock, AR; Kansas City, MO; Springfield, MO; St. Louis, MO; Oklahoma City, OK; Memphis, TN; Nashville, TN; Austin, TX; Dallas, TX; Fort Worth, TX; and Houston, TX.

Strong preference will be given to candidates willing to relocate to Little Rock, AR.
