Kinsale is an Excess & Surplus lines insurer specializing in hard-to-place, small to medium sized commercial accounts. Kinsale is eligible in all states and writes a variety of Property, Casualty and Specialty lines. Kinsale will consider offering terms on a wide range of risks including accounts with new or high hazard operations and businesses that have a poor loss history or that are located in high risk venues.

Responsibilities: The Attorney will be responsible for overseeing all aspects of the coverage litigation process. Duties include analyzing coverage issues, evaluating claims handling and underwriting practices, and determining exposure for all levels of coverage litigation. Works closely with outside counsel to draft pleadings and motions that are consistent with Kinsale’s coverage positions and proprietary policy forms. Reviews and responds to subpoenas and complaints filed with individual state insurance departments. Participates in mediations, arbitrations, and trials, and travels as necessary. Must be able to prepare comprehensive coverage position papers that take venue and claims handling practices into account. Effectively communicate with agents, brokers, and other attorneys both orally and in writing. Works closely with senior management on identifying best claims handling and underwriting practices while also providing advice and assistance in efforts to respond to changes in the legal environment.

Qualifications:

  • Superior writing demonstrated by the ability to conceptualize and draft claim correspondence, coverage positions, and litigation pleadings and motions.
  • Ability to analyze and interpret state laws, regulations and case law relating to insurance coverage and claims handling practices.
  • Background in litigation, preferably involving insurance claims and coverage
  • Detail-oriented with strong interpersonal skills and organizational ability.
  • Experience in commercial property and casualty insurance industry, preferably in the excess and surplus market.

Education and Certifications:

  • Four year college degree.
  • J.D. Degree.
  • Admission to practice law in at least one state required.
