OVERALL RESPONSIBILITIES:

The Excess Exposure Specialist/Counsel will help guide both the Legal and Claims teams on identifying and mitigating the risks associated with potential excess of policy limit claims exposure and will also have responsibility for the management of the Companys internal repository of relevant case data and results. The role will research, devise, manage, update, and synthesize data, developments and bad faith case law on a national and Company level basis. The successful candidate will understand and be responsible for driving our
Companys strategies and initiatives aimed at mitigating potential bad faith exposure. Success in this role will involve the development and implementation of a fully functioning, inter-departmental system for assessing/understanding, managing and mitigating potential excess of policy limits exposure to the Company.

SPECIFIC DUTIES:

Strategic:

  • Prepare a comprehensive strategy to address potential excess of policy limits exposure to the Company.
  • Generate a multi-year plan providing the objectives, tactics and resources needed to operationalize the identified approach to managing such risk/exposure.
  • Review claims files in real-time and provide feedback on the presence and extent of any alleged potential excess of policy limits exposure, and if none deemed present, re-affirm defense strategy.
  • Monitor the claims trial calendar and ensure that every claim going to trial has been reviewed.
  • Conduct an internal analysis of claims approach and assess any opportunities to proactively mitigate such exposure during routine file management.
  • Optimize the selection of external legal partners (as needed) to assess and address such exposure and defend against bad faith litigation.
  • Develop notification system and share relevant case developments with Legal and Claims staffs.
  • Develop a strategy for notification of and memorialization of developments in national bad faith law.
  • Anticipate developments in bad faith law and legal standards in relevant jurisdictions.
  • Present to key stakeholders on the impact of various legal developments in bad faith law and other laws impacting medical malpractice and the provision of medical care.

Operational:

  • Partner with Claims/Legal teams to ensure that the Company is optimally managing its potential excess of policy limits exposure.
  • Draft plan timelines and deadlines in conformity with Companys strategic plan guidance.
  • Cultivate relationships with key stakeholders to drive results.

QUALIFICATIONS, EXPERIENCE REQUIRED:

  • Bachelors Degree and J.D. required
  • At least 5 years of experience with and exposure to insurance coverage litigation, particularly bad faith cases or other relevant insurance industry experience.
  • Ability to think outside the box and to apply legal principles to nontraditional and unconventional circumstances.
  • Demonstrated success with data analysis and synthetization of large volume of legal data.
  • Highly organized with strong attention-to-detail.
  • Proactive and creative thinker.
  • Highly adaptable to changing priorities and business needs.
  • Operates autonomously.
