Deputy General Counsel
The Deputy General Counsel is the primary legal counsel for an organization’s fast-paced consumer lending business focused on recreational vehicle lending (boats, RVs, etc) and home improvement lending. and will manage the consumer legal team group. This individual will be a key partner to management and the business partners and assist in developing strategies to execute on the business’ goals while managing the organization’s legal risk. The Deputy General Counsel must understand best practices to assist with the assessment of current and proposed practices. Critical to success in this role is being able to manage multiple priorities, simplify complex legal concepts to effectively communicate them and provide recommendations to the business to help achieve the company’s goals. The Deputy General Counsel will oversee other attorneys, external counsel, work closely with compliance personnel. Essential Functions
Interpret state and Federal regulatory requirements related to direct and indirect consumer financing, servicing, and collections.
Manage regulatory inquiries and licensing requirements for a state licensed finance, servicing, and collections company.
Advise on loan portfolio acquisitions and integrations.
Work with a variety of company departments to implement new products and services.
Address disputes related to collections and servicing matters, including management of external counsel.
Review policies, procedures, and practices to ensure compliance with legal requirements.
Required Education and Experience
Juris doctor degree from an ABA approved law school
10+ years’ experience as an attorney advising consumer finance companies (in-house experience preferred)
Licensed by and in good standing with the at least one US state bar
Experience with indirect and direct lending models
Knowledge and application of federal consumer protection laws and regulations, including but not limited to, ECOA, TILA, EFTA, FCRA, TCPA, CAN-SPAM, GLBA, UETA, ESIGN, FDCPA and UDAAP, and any state-level statutory and regulatory counterparts
Proficient in the utilization of Microsoft Office Suite
Attention to detail and accuracy required
