Minimum Qualifications Minimum Qualifications:
Transfers: One year of permanent competitive or 55b/c service in this title or in a title eligible for 70.1 or 52.6 transfer.

Open to the Public: This title is part of the New York Hiring for Emergency Limited Placement Statewide program (NY HELPS). For the duration of the NY HELPS Program, this title may be filled via a non-competitive appointment, if the candidate meets the below NY HELPS minimum qualifications.

NY HELPS Non-Competitive Minimum Qualifications:

Position may be filled at the Senior Attorney level or one of the Assistant Attorney traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.

Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission.

Assistant Attorney 2 (Grade 20): Admission to NYS Bar

Assistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience

Senior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience

NOTE: Admission to the New York State Bar and current registration to practice law in New York State is required for continued employment. Disbarment or loss of registration shall result in termination or suspension of employment.
This position may be designated 55 b/c and is subject to verification of applicant eligibility.

Duties Description The Senior Attorney will provide legal assistance and support to agency program administrators by analyzing legal opinions, briefs and other material, preparing memoranda of law and conferring with administrators or parties to legal action in order to mediate, negotiate or settle legal issues directly related to the agencys program. The incumbent will function either as a specialist in a single program governed by law or in a more general atmosphere as evidenced by their concern with laws governing numerous programs. Senior Attorneys in the Division of Legal Affairs, NYSDOH, will have general knowledge or a background in Administrative Hearings, Medical Conduct/Misconduct, Litigation, FOIL, Criminal Records Check, and Program Counsel. The incumbent will be knowledgeable and have experience with NYS Public Health Law. The incumbent will initiate legal actions and other proceedings or receive cases from superiors and prepares charges, specifications and orders to defendants; analyze and summarize cases and information pertinent to constitutional provisions, statues, rules, regulations, policies and opinions and plans litigation strategy; prepares for judicial or administrative proceedings by reviewing cases, discussing strategy, coordinating investigations, examining case folders, conferring with program officials, prepare legal memoranda and issuing subpoenas; assists or personally conducts hearings; analyze legislation proposed by others for legal sufficiency and/or effect on agency programs; reviews, analyzes, and comments on changes in laws, rules, regulations, etc., concerning effect on agency programs, to determine need for changes in agency laws; recommends technical corrections and amendments to existing laws; drafts legislation and supporting memoranda and prepares request to Governors Office and legislative leaders for introduction.

Additional Comments "The Senior Attorney/Traineeship titles are part of the NYS HELPS program. For the duration of the HELPS Program, these titles may be filled via permanent non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the titles for which they apply. At the close of the HELPS program, employees hired under the HELPS Program will have their non-competitive employment status converted to competitive status. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State.

Depending on how the candidates qualifies, the positions could be filled as competitive or non-competitive. Additionally, the positions may be filled in Albany or New York City. New York City employees will receive a downstate adjustment of $3,026."
