PRIMARY RESPONSIBILITIES
- Supports bidding and procurement functions by reviewing, drafting, and negotiating construction-related contracts (design-build agreements, prime contracts, subcontracts, purchase agreements, joint venture agreements, leases, etc.) according to company policies.
- Ongoing support on interpretation of contracts and claim management procedures; advising on claims as they arise.
- Evaluate and respond to legal process documents served on the Company.
- Provides legal advice in compliance with all applicable federal, state, and local laws, regulations, and rules.
- Assists in the efficient use, management, and evaluation of outside counsel.
- Manages litigation, arbitration, and mediation processes as necessary, including discovery support.
- Responds to disclosure requests for procurements and prequalifications.
- Advises the Executive team on new developments in the law and proactively identifies problem areas to minimize risk.
- Negotiates workable solutions to complex and sensitive legal issues.
- Works with Executives and legal teams to resolve any project specific issues and to provide legal advice; maintains open and transparent communications and is willing to take direction.
- Prepares prime contract legal reviews for major procurements.
- Performs other related duties as required and assigned.
REQUIREMENTS
- Bachelor’s degree (technical field a plus), Juris Doctorate, and a state bar admission required.
- 7 - 10 years of legal experience with a minimum of 5 years of experience in contracts and negotiations a must.
- At least 5 years of construction law experience is required, preferably in-house.
- Team player with strong communication skills, reporting skills, analytical skills, negotiating skills, and organizational capabilities.
- Proficiency with Microsoft Office Suite, Word, Excel, and Outlook is required.
- Familiarity with contract documents and/or contract law.
- Admission to Arizona Bar, California Bar, and/or Texas Bar is highly desirable. Ability to qualify for In-House Counsel status with the State Bar of Arizona.
