MINIMUM QUALIFICATIONS:
Possession of a license to practice law in the state of Louisiana.
Function of Work:
To assist an attorney of higher rank in the preparation of court cases and/or advisory opinions and may litigate and/or prepare advisory opinions in cases of a routine nature.

Level of Work:
Entry.

Supervision Received:
General from a higher ranking attorney, administrative law judge, or other agency administrator/executive.

Supervision Exercised:
None.

Location of Work:
May be used in all agencies.

Job Distinctions:
Differs from Attorney 2 by the level of supervision received and the level of expertise required in the preparation of legal opinions/courts cases assigned or hearings conducted.

This position is located within the Office of Management & Finance Legal department and funded by the Office of Agricultural & Environmental Sciences (AES), within the Department of Agriculture and Forestry. This position reports directly to the Executive Counsel and is assigned to provide legal duties.

20% - Case Preparation and Presentation
Assists in investigating complaints regarding possible violations of laws or rules and regulations applicable to the agency and other matters that are being considered for possible administrative, civil, or criminal action. The investigatory duties may include locating and interviewing witnesses and obtaining and authenticating or validating information and documents.

Assists in determining whether a complaint and any resulting investigation indicates that the action complained of is apparent violation of applicable laws or regulations and whether there is sufficient evidence to support the filing of administrative charges or the taking of other legal action in regard to the complaint; recommend or advise against enforcement proceedings; and obtain and incorporate technical information from the agency's technical staff into memoranda and for use in agency proceedings.

20% - Administrative Hearing
Prepares for and presents administrative adjudicatory hearings among various boards and commissions. Assists in preparation, research, and monitoring of cases in litigation in state or federal court.

20% - Draft Legal Documents
Incumbent is responsible for drafting the following: charge letters, stipulations and other documents related to administrative adjudicatory proceedings; petitions, discovery, and other legal documents relative to litigation; contracts; leases, memorandums of understanding; cooperative agreements; legal memoranda and opinions; enforcement orders to responsible parties; letters and other communications to other parties and other documents relative to the business and affairs of the agency; proposed legislation, rules and regulations, and civil or criminal enforcement referral packages to the attorney general, a district attorney, state or federal agency or other law enforcement officer or agency.

15% Public Records Request
Process, collect, review, responds and track public records requests; facilitates compliance with public records law.

10% - Legal and Other Research
Conducts legal research for the purpose of finding relevant statutes, rules and regulations, ordinances, or other governmental edicts; applicable court decisions; usable articles and other writings dealing with law or facts.

10% - Legislation and Promulgating Rules and Regulations
Assist in monitoring and drafting new or proposed legislation. Prepares rules and regulations through the promulgation process provided for the Administrative Procedure Act

5% - Administrative Duties
Prepares briefing memoranda for or to officials of the agency and the department; conducts briefings to such officials; attends or conducts meetings or conferences related to the affairs of the agency_

Performs other duties as assigned.
