Claims Counsel is a technical resource within the Markel Claims that manages litigated and pre-litigation claim matters involving allegations of bad faith or which seek extra-contractual damages against Markel-related companies; assists in reviewing pleadings, motions, release and discovery in declaratory judgment actions filed on behalf of the Company or filed against the Company which do not allege bad faith. Claims Counsel also assists Markel Claims with responses to consumer complaints and subpoenas.

Claims Counsel is a critical thinker in case-management; engages in independent analysis and evaluation of claims involving allegations of bad faith, which seek extra-contractual damages, or in which such exposures are alleged or may be created by the handling or outcome of a non-extra-contractual matter; engages in independent analysis of cases handled by other product lines on an as requested basis; and acts in a consultant role in case conferences. Claims Counsel will also coordinate and participate in training.

  • Manage matters involving bad faith allegations or which seek extra-contractual damages against Markel arising primarily from First Party Property, Transportation and Special Programs claims.
  • Review proposed declaratory judgment actions
  • Review pleadings, affidavits, corporate disclosures (as requested), draft discovery responses and settlement agreements in suits against the Company
  • Assist in reviewing and responding to pre-suit demands, policy limit demands, 93A notices, civil remedy notices, DTPA demands, and department of insurance complaints.
  • Assist in deposition preparation
  • Provide technical guidance to Markel Claims Specialists, Managers and Directors on an as requested basis
  • Provide training as to bad faith and on other topics on an as requested basis
  • Participate in case conferences with Markel CLaims Specialists, Managers, Directors and /or Underwriters on an as requested basis and ad hoc basis
  • Review and/or draft of correspondence to personal counsel for insureds and business partners as requested.
  • Provide information to business partners about changes in the legal environment
  • Coordinate with Legal and Compliance divisions on Claims related issues.
  • Complete quarterly surveys on suits against the Company
  • Provide data/metrics information on claims and lawsuits
  • Assist in reviewing responses to claims-related Department of Insurance Complaints, Civil Remedy Notices and Subpoenas
  • Presentations to Claims and Underwriting as requested
  • Assist with special projects as requested
  • 25% travel may be required

Education

  • Bachelors degree required
  • JD required
  • Must have active law license in at least 1 state

Work Experience

  • 3-7 years experience analyzing coverage under commercial and residential property policies
  • 3-7 years experience litigating breach of contract and extra-contractual claims against insurers in first-party coverage matters.
