SUMMARY DESCRIPTION
Under administrative direction, perform high-level and complex professional legal and administrative work; to oversee and supervise all matters of litigation; supervise subordinate attorneys and support staff on litigation matters; provide legal research, advice, and counsel to City staff, City boards, and commissions; review and draft contracts, ordinances, and other documents; serve as Acting City Attorney in the temporary absence of the City Attorney; and provide highly responsible and complex administrative support to the City Attorney.

DISTINGUISHING CHARACTERISTICS
This is a mid-management position responsible for providing high-level and complex professional legal and administrative work to the City Attorney's Office. This position provides functional and technical direction to the Deputy City Attorney class and exercises supervision over office support staff related to the litigation function. Incumbents are responsible for the direction and outcome of litigation and other related matters.

The following duties are typical for this classification. Incumbents may not perform all of the listed duties and/or may be required to perform additional or different duties from those set forth below to address business needs and changing business practices.
  1. Prepare pleadings and make appearances in Court on litigated matters; develop strategy and formulate tactics regarding individual litigation matters while understanding the broader organizational impacts of individual litigation decisions.
  2. Prepare and represent the City in fulfilling its obligations in Pitchess motions involving peace officer personnel files.
  3. Oversee the litigation docket and calendaring system and set priorities for completing litigation-related work in an efficient and timely manner; evaluate claims filed against the City and provide direction for appropriate litigation holds and releases; monitor for trends in claims that may require action by management or change in City procedures; and supervise and oversee litigation matters assigned to outside special counsel.
  4. Develop and monitor individual litigation budgets and provide direct input into development of the overall department budget; prepare updates, information, briefings, and requests for authority recommendations.
  5. Perform personnel related legal research, prepare legal opinions, and advise on personnel matters; prosecute management cases before the Personnel Board regarding employee discipline and grievance matters; and provide advice to management regarding compliance with the Peace Officers Procedural Bills of Rights (POBR) and the Firefighters Procedural Bills of Rights (FOBR).
  6. Represent the City before administrative agencies; perform legal research and prepare opinions regarding City business; and provide verbal and written advice to other City departments, as necessary.
  7. Draft and review legal documents, including, but not limited to, contracts, ordinances, resolutions, leases, and deeds.
  8. Respond to and resolve difficult, complex, and sensitive citizen inquiries and complaints.
  9. Analyze recent cases and legislation and recommend changes in policies and procedures to meet legal requirements.
  10. Assist in organizing and coordinating the work in the City Attorney's Office; perform special projects and assignments; and serve as acting City Attorney in the temporary absence of the City Attorney.
  11. Perform related duties as required.
QUALIFICATIONS
The following generally describes the knowledge and ability required to enter the job and/or be learned within a short period of time in order to successfully perform the assigned duties.

Knowledge of:
Principles and practices of municipal law, including the functions of California Charter law cities and their various departments.
Pertinent, local, state, and federal laws, codes, statutes, and constitutional provisions affecting municipal operations.
Effective public speaking techniques.
Principles, methods, and techniques of legal research and investigation.
Judicial procedures and rules of evidence.
Conduct of hearings in court and administrative proceedings.
Familiarity with public personnel and employment law and employee disciplinary proceedings.
Office procedures, methods, and equipment including computers and applicable software applications such as word processing, spreadsheets, and databases.

Ability to:
Perform professional legal research.
Appear and try civil and criminal cases in both State and Federal Courts.
Analyze and apply legal principles to complex problems.
Develop strategy and tactics for complex litigation matters.
Plan and organize work to meet changing priorities and deadlines.
Conduct research on legal problems and prepare sound legal opinion.
Define legal issues, collect and analyze information, and recommend action.
Effectively represent the City and the City Attorney's Office to outside individuals and agencies to accomplish the goals and objectives of the unit.
Maintain confidentiality.
Work collaboratively and independently.
Relate effectively to those contacted in the course of work, being tactful and courteous.
Distinguish between legal and policy matters.
Operate office equipment including computers and supporting word processing, spreadsheet, and
database applications.
Communicate clearly and concisely, both orally and in writing.
Establish and maintain effective working relationships with those contacted in the course of work.

Education and Experience Guidelines - Any combination of education and experience that would likely provide the required knowledge and abilities is qualifying. A typical way to obtain the knowledge and abilities would be:
Education/Training:
A Juris Doctorate Degree from an American Bar Association or California State accredited school of law.
Experience:
Five years of increasingly responsible professional legal experience, with three years of which must have been in California in an area of law applicable to municipal government operations.
License or Certificate:
Active membership in the State Bar of California.
Possession of an appropriate California Driver license.

Special Requirements:
Incumbent will be required to file a Statement of Economic Interest under the Fair Political Practices Commission.
Must be willing and able to work the hours necessary to accomplish the job requirements, including working irregular hours, attend evening meetings, and travel to attend court, classes, meetings, and/or seminars, as required.
