Job Description

Basic Purpose

The Deputy General Counsel reports to the General Counsel (GC) and provides legal advice to the agency and board and represents OHCA in both administrative and judicial proceedings.

Typical Functions

  • Serves as the Deputy General Counsel V and is the principal contact in the absence of the General Counsels or assists as directed.
  • Assists in the planning, organizing, supervision, direction, and coordination of the activities of the Division.
  • Serves as liaison to the SoonerSelect Operations team. Serve in-house counsel needs for questions regarding program area in consultation with other attorneys in division regarding particularized legal matters. Answers general program questions.
  • Exercise full responsibility for the development, preparation, and presentation of agency before administrative proceedings that involve more complex program issues within the Medicaid Program.
  • Performs litigation duties in State and Federal Court in defense of the agency in response to legal action brought by the agency or filed against the agency, as assigned by the General Counsel.
  • Senior legal advisory on law and regulation involving more complex issues involving SoonerSelect, SoonerSelect plan compliance and enforcement.
  • Makes oral and / or written presentations to agency management, OHCA Board, legislative staff, and committees Medicaid programs.
  • Analyze, research and review record requests that involve the Open Records Act, HIPAA, or Medicaid Confidentiality laws.
  • Act as liaison to legislature on select issues. Review, analyze, and appear at legislative committees when requested to take agency position or answer legal questions regarding agency action.
  • Staffs Open Meetings and serves as counsel for OHCA Board and Committees, as needed.
  • Manages the Performance Management Process for the staff that directly reports to the position; develops job accountabilities, designates accountability priority, performs employee evaluations, documents performance, and conveys such to employee, and creates employee development plans.
  • Exercises mentor role or lead role to develop attorneys at level I/II/III/IV.

Travel: Travel on an as needed basis.

Supervisory Responsibilities: Supervisory duties.

Education and Experience

  • Bachelors degree AND
  • Juris Doctorate Degree from ABA accredited Law School AND
  • A minimum of eight years of experience in the practice of law AND
  • Active Member of the State Bar of Oklahoma

Preference May Be Given to Candidates With:

  • Senior level administrative experience at OHCA
  • Legal experience at OHCA
  • Litigation experience
  • Other relevant legal and/or administrative experience
  • Significant background in health care administration, health care insurance and/or state or federal health care programs
  • Advanced education
  • Additional certifications
  • Use of computer research & case management software

Special Requirements

Physical Demands:

  • Must be able to remain sitting for prolonged periods at a desk and working on a computer.
  • Must be able to move or lift up to 15 pounds at various times.

Work Environment:

  • The office work environment includes regular exposure to general office equipment such as computer equipment, phones, and copy machines.
