Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had two years of experience in the practice of law subsequent to admission to the Bar.

Duties Description Reporting to an Associate Counsel for Litigation and Compliance, the Assistant Counsel will be primarily responsible for managing a portion of OCMs administrative hearings matters and assist with follow-up actions in Supreme Court related to enforcing OCM orders.
In collaboration with OCMs Enforcement Unit, the incumbent will prepare for judicial or administrative proceedings by reviewing cases involving licensed and unlicensed businesses, discussing strategy, coordinating investigations, examining case folders, conferring with program officials, preparing complaints and legal memoranda, and issuing subpoenas.
Prepare and present cases at proceedings by preparing opening statements and summations, arguing motions, examining witnesses, consulting with parties to the proceeding, examining evidence, preparing briefs, negotiating settlement, preparing appeals, and advising superiors.
Review, analyze, and comment on amendments to regulations pertaining to compliance, enforcement, and administrative hearings related thereto.
Perform other duties and special projects as required.

Additional Comments NOTE:
Travel may be required (approximately 5%), including during evening and weekends, depending on mission and assignment.
Possession and maintenance of a valid Drivers License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.
