The Nebraska Department of Motor Vehicles is seeking a well-qualified, experienced candidate to join our Legal Division as an Attorney III. Are you a natural problem solver? This is the third in the five level Attorney series (Attorney I, Attorney II, Attorney III, Agency Assistant Legal Counsel, and Agency Legal Counsel). Positions in this series provide legal services to the agency, based on admission to the Nebraska Bar, with the level determined by factors such as difficulty of work assigned, and degree of decision-making authority and discretion exercised.
This position will serve as an Attorney III for the agency, promulgate rules and regulations, serve as the staff attorney to the divisions of the DMV, review data audits for compliance with federal and Nebraska law, contracts for the agency, human resource matters, and perform assign duties by Agency Legal Counsel.


REQUIREMENTS: Three years of experience as an attorney practicing law and providing legal service, such as preparing cases, advising clients, and/or interpreting laws or administrative policies. In accordance with Section 7-101, Nebraska Revised, Reissued Statues of 1943, incumbents in this class must be Admitted to the Nebraska Bar.

Preferred: Knowledge of motor vehicle laws, contracts, human resource matters, administrative hearings and procedures, and rules and regulations promulgation.

Draft proposed findings of fact, conclusions of law, and recommended orders for the Director. Provide legal support to the Financial Responsibility Division. Review all federal laws and maintain compliance with all federal requirements. Review compliance of all persons and entities requesting and assessing agency data for federal and Nebraska statutory law compliance.

Corresponding and answering legal calls and inquiries from the public, attorneys, law enforcement, and other governmental entities. Knowledge of all agency statues, rules and regulations, policies and procedures that pertain to possible inquiries. Draft and promulgate agency rules and regulations as required by the Administrative Procedure Act. Projects and correspondence as assigned by Agency Legal Counsel. Assist Agency Legal Counsel with the review and response to public records request. Prepare and maintain contracts for the agency. Review and assist Agency Legal Counsel with Human Resource matters for the agency. Confer with the Director, Agency Legal Counsel, Staff Attorneys, and Agency Administrators on the facts and status of issues, cases, and other legal/administrative actions that impact the agency. Research federal rules and recent court decisions for agency impact. Analyze legal issues and compare agency documents to help guide agency policies and practices. Counsel legal staff on issuance of discovery, subpoenas, and preparation for hearings. Analyze appeals and miscellaneous petitions before the agency.

Knowledge, Skills and Abilities:

Knowledge of the techniques of preparing/drafting legal documents and forms; the principles and practices of criminal and civil law administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings.

Skilled in: Preparing summaries, legal analysts, findings, conclusions, briefs, and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of continuous goals or viewpoints.

Ability to: Prepare and communicate in person and by phone, emails, summaries, and correspondence, the facts and arguments of a case to persuade others to accept the viewpoint presented; interact with legal associates, other government employees, the public, and representatives of the parties involved in a case; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; prepare drafts of legal documents and forms; identify critical elements of a legal question or issues and select appropriate course of action; interpret and apply statues, case law, decisions of judicial and administrative hearings, and administrative rules and policies.

Are the requirements for this classification regulated by a license, certificate and/or degree?

Yes. In accordance with Section 7-101, Nebraska Revised, Reissued Statues of 1943, incumbents in this class must be Admitted to the Nebraska Bar and have obtained a Juris Doctorate from an accredited law school.

Is driving required:

Yes. Limited driving. Hold a valid Nebraska drivers license.
