Office of Mineral Resources Executive Division
The Office of Mineral Resources (OMR) was established to manage the states mineral assets in granting and administering leases on state-owned lands and water bottoms for developing and producing, primarily oil and gas, as a means of revenue in the form of royalties, bonuses, and rentals to the states general fund.

The Executive Division of the Office of Mineral Resources performs general administrative duties for the State Mineral and Energy Board (Board) and manages overall office operations, including budget administration, personnel matters, and purchasing. The Division also manages professional services contracts that assist the Board and issues non-exclusive seismic permits for surveys over State-owned lands and water bottoms.

Employees are eligible for flexible work schedules upon hire and up to two (2) days of telework after six (6) months.

LOCATION AND POSITION INFORMATION:
This Attorney 1-4 is located in the Executive Division within the Office of Mineral Resources (OMR) in Baton Rouge, LA. This position reports directly to the Assistant Secretary and serves as their legal advisor. The Attorney position is part of a career progression group (CPG) and serves as an attorney/specialist in legal matters related to the ownership and leading of land rights such as mineral rights, carbon sequestration, and renewable energy. The Attorney position requires knowledge and experience in various complex areas of law and regulations including title/ownership of immovable property, leading, assignments and transfers of mineral leases, operating agreements, working interest ownership, proper payment of royalties, as well as general contract and administrative law. Additionally, this position will assist the Assistant Secretary in managing other attorneys in the department and OMR staff to inquire into, manage, and resolve any legal matters or conflicts that exist and/or arise in the Office. The position may also support the Attorney Generals office related to matters that it is handling for OMR.

Additional duties and responsibilities include, but are not limited to the following:

  • Coordinates with the Assistant Secretary, department attorneys, the Attorney Generals office, and the State Land Office to oversee ongoing litigation matters.
  • Advises the Assistant Secretary, OMR and State Mineral and Energy Board in the areas of mineral and energy law including but not limited to mineral lease or operating agreement maintenance, royalty payments and related audits, mineral rights, carob sequestration, renewable energy, administrative procedure, constitutional issues, unitization agreements, operating agreements, Public Records Law, and Open Meetings Law.
  • Participates in agenda reviews and assist the Assistant Secretary and OMR in advising the State Mineral and Energy Board
  • Advises on all contracts and matters relevant to the oil and gas industry, carbon sequestration, and renewable energy.
  • Drafts, reviews, and amends complex legal and commercial contracts.
  • Legal research, projects, and all other duties as assigned by the Assistant Secretary.

Job Distinctions:
Differs from Attorney 2 by the level of supervision received and the level of expertise required in the preparation of legal opinions/courts cases assigned or hearings conducted.ATTORNEY:
Litigates routine cases in trial and appellate courts and before administrative tribunals under the supervision of a higher ranking attorney.

Assists an attorney of higher rank in preparing major or complex cases for trial by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs.

Enters claims for collecting monies due the state.

Assists in preparing proposed legislation.

Drafts tentative rules and regulations and reviews rules, regulations, and bulletins prepared by administrative officers for conformity to the law.

Investigates reports of violations of statutes and administrative rules and regulations.

Prepares advisory opinions for review by a higher ranking attorney.

Prepares or reviews legal documents, including contracts, licenses, deeds, and abstracts.

Researches laws applicable to the above activities.

To conduct hearings and to render decisions.

ATTORNEY--ADMINISTRATIVE LAW JUDGES/REFEREES:
Convenes hearings that are of a routine nature; issues subpoenas; administers oaths; hears testimony; considers evidence; examines witnesses; maintains order; rules on motions, objections, admissibility of evidence and procedure; prepares and issues decisions and orders based upon all evidence gathered, research of pertinent statutes, pertinent jurisprudence, and independent assessment of acts based on credibility of witnesses and evidence.

Conducts pre-trial conferences with the attorneys to resolve preliminary issues and narrow the scope of the hearing to the facts actually in dispute.

Determines if there are jurisdictional or procedural issues to be disposed of and if so, decides the most appropriate manner (i.e. a limited hearing, an order to brief the issue, an order to amend the pleadings, a status conference, etc.) to address these issues.

Secures, compiles, and maintains all records of adjudications. Ensures that accurate records are maintained in the proceedings that evidence is properly marked and included in the case record, and that audio recordings are accurately marked and properly indexed and stores.

Conducts a continuous study of the current statues, regulations and case law related to areas of law for which hearings are assigned.
