The Insurance Section of the Department of Justice litigates cases on behalf of several state agencies. The primary purpose of the Section is to represent the Commissioner of Insurance, the Department of Insurance, and Department of Insurance-affiliated boards and commissions such as the N.C. Building Code Council, the N.C. Code Officials Qualifications Board, the N.C. Manufactured Housing Board, the North Carolina Home Inspector Licensure Board, and the N.C. Fire and Rescue Commission.

The major focus of this position is to litigate cases on behalf of all divisions of the North Carolina Department of Insurance (NCDOI), in administrative proceedings, North Carolina trial courts and North Carolina appellate courts throughout the state, and in the Federal Courts. The attorney in this position has responsibility for independently handling complex litigation and will be required to resolve important, difficult legal issues.

Responsibilities and Duties:
1. Represent NCDOI and its Employees in Litigation
  • The primary purpose of this position is representing NCDOI, and potentially employees of NCDOI, in litigation and rendering litigation assistance to the various divisions of NCDOI.
  • The major focus of this position is to represent the NCDOI in litigation before and during legal proceedings in federal court, state court, and in administrative hearings. In order to prepare for these cases, this attorney will assimilate the facts, develop case strategies and tactics, research novel points of law, some of which may involve issues of first impression, draft legal documents, interview witnesses, prepare pleadings, motions, discovery and other legal documents required for judicial and administrative proceedings.
  • This attorney will conduct and defend depositions. This attorney is responsible for court appearances at the trial and appellate levels and for negotiating settlements as appropriate.
  • Insurance companies are represented by highly qualified and experienced attorneys. Litigation involving insurance companies often involves understanding and presenting complicated financial evidence.
2. Advice to NCDOI and related Boards, and Commissions.
  • This attorney gives advice, counsel and assistance to the Bail Bond Regulatory Division (BBRD) with respect to matters involving the licensing, regulation and discipline of bail bondsmen.
  • This attorney gives advice, counsel and assistance to the Agent Services Division of the Department of Insurance, whose responsibility is to regulate insurance agent licenses, broker licenses, adjuster licenses, and collection agency permits.
  • This attorneys responsibilities can include giving advice to the Financial Evaluation Division of NCDOI.
  • This attorneys responsibilities can include advising the Market Regulation Division of the Department of Insurance in its duties in examining insurers (whether property, life or health insurers) and other regulated entities to determine if the regulated entities marketing and claims payment practices are in compliance with North Carolina law.
3. Respond to inquiries from non-client State Agencies, Legislators, the Judiciary, Local Judiciary, Local Government Agencies, and the General Public
  • This attorney provides oral or written responses to legislators, State and local officials and others. These requests may involve, among other topics, the interpretation of Chapter 58 of the General Statutes.

The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.


THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $84,878 to $100,179. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Hybrid telework opportunities are available for this position. Thorough knowledge of statutory, case and administrative law surrounding the regulatory authority of the clients represented.

Thorough knowledge of jurisprudence and statutory case and administrative law surrounding the regulation of insurance companies and other entities licensed by the Department.

Thorough knowledge of North Carolina rules of procedure, court and practice (trial and appellate), including the Rules of Professional Conduct.

Understanding of corporate and business law and generally accepted accounting practices and principles.

This work also requires the attorney to become familiar with actuarial methodologies, jargon and concepts, information technology procedures, economics and statistics, actuarial and accounting principles, medical issues, engineering concepts, home construction concepts, various Federal government programs, and various other areas of technical expertise.

Ability to analyze, interpret and act upon statutory provisions and case law.

Ability to express conclusions and arguments correctly and logically in written and oral forms.

Ability to effectively advise a governmental official.

Ability to apply good judgment and discretion to the exercise of job responsibilities.

Strong and confident negotiation skills.

Ability to maintain an effective working relationship with the public and other persons contacted in course of work. Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.
