Job Description:

Seeking a highly motivated attorney to join the Bank of America legal team. This position will primarily provide legal support to the Bank’s Fraud & Claims and Safe Deposit Box business areas. While the focus of the role is primarily related to Consumer Deposits products and operations, the position’s responsibilities will extend into other products/areas such as Commercial and Wealth Management.

As part of a Global Technology & Operations Legal team that provides support to a broad array of operational areas, the position will also frequently engage with and provide support related to other areas such as Global Financial Crimes, Deceased Customer Servicing, Financial Centers, Military Affairs, Complaints, Internal Investigations, Legal Order Processing, Marketing, Collections, Media Relations, Audit, Risk, Compliance and Identity Theft Prevention. 

Typical fraud and non-fraud claims supported by this position primarily relate to Reg E/EFTA, wire transfers and account closures, but may also include check fraud claims as well as other types of claims.  The role also provides support for related processes, controls and reporting, the company’s fraud-related policies, strategies and detection efforts, and other areas such as at-risk persons, investigations and law enforcement interaction.  Finally, the position provides all aspects of legal support for the Bank’s Safe Deposit Box product and operations, including rental agreement terms, access issues, claims, financial center operational changes, disaster recovery, box closures, etc.

The ideal attorney candidate will have a strong financial services regulatory background working within the above areas, with a particular focus on Reg E/EFTA (consumer electronic transactions), FCRA (adverse action, permissible purpose, identity theft), SAR reporting (BSA), SCRA, at-risk person exploitation, fraud investigations, offsets, deposit products, victim funds handling, hold harmless/indemnification agreements, fraud mitigation products, safe deposit boxes, bankruptcy, policies, procedures and training.  Prior experience with UCC articles 3, 4 and 4A (negotiable instruments, bank collections, fund transfers) and Reg CC (funds availability, check collection) is a plus as well.

The candidate will be responsible for advising business and compliance partners and also will partner with other legal colleagues and subject matter experts. This candidate often will serve as primary point of legal contact on strategic business initiatives and must be capable of working independently and as a subject matter expert. While not a management position, the candidate will be responsible for overseeing the activities of one or more paralegals who also support the above-referenced areas.

Enterprise Description:

Provides general legal counsel on Operations related matters, as well as specific advice on products, services and certain legal actions. Reviews legal contracts and documents. Directly, or through staff, conducts legal research. May represent the bank in legal actions. Individuals in this position must be a member of the Bar.
